These Terms of Service apply to your use of The Spoilt Dog Co. website and to purchases made through our online store.
The Spoilt Dog Co. is operated by B & K Property (SW) Ltd, a company registered in England and Wales under company number 05926438 and VAT number GB 498 5743 22.
By using our website or placing an order, you agree to these Terms of Service. Nothing in these terms affects your statutory rights as a consumer.
1. Our products
We aim to describe and display our products as accurately as possible. Colours and appearance may vary slightly depending on your device, photography and normal manufacturing variations.
Product availability may change without notice.
Some products are supplied and dispatched directly by selected fulfilment partners. Your contract of sale remains with The Spoilt Dog Co. and this does not affect your consumer rights.
2. Orders
When you place an order, you are offering to purchase the products in your order.
We reserve the right to decline or cancel an order where reasonably necessary, for example if a product becomes unavailable, there has been an obvious pricing or description error, or we reasonably suspect fraudulent activity.
If we cancel an order after payment has been taken, we will refund the appropriate amount to your original payment method.
3. Prices and payment
Prices are shown in pounds sterling (£) unless stated otherwise.
Prices include VAT where applicable. Any delivery charges will be displayed during checkout before you complete your purchase.
Payment must be successfully authorised before an order can be processed.
4. Delivery
Delivery options, charges and estimated delivery times will be displayed at checkout where available.
Because we use selected supplier and fulfilment partners, products from the same order may occasionally arrive separately.
Delivery dates and times are estimates unless expressly stated otherwise.
Goods remain at our risk until they are delivered to you, or to another person identified by you to receive them, except where you independently arrange a carrier that we have not offered.
Please ensure that the delivery information you provide is complete and accurate.
5. Returns, cancellations and refunds
Your rights to cancel an order, return products and receive refunds are explained in our Returns & Refunds Policy.
Nothing in these terms limits your statutory rights under UK consumer law.
6. Personalised products
Some products can be personalised or made specifically to your requirements.
Please check names, wording, sizes and other personalised information carefully before submitting your order.
Personalised or custom-made products may not qualify for the usual change-of-mind cancellation rights. This does not affect your rights where an item is faulty, damaged or not as described.
7. Product safety and use
Products should only be used for their intended purpose and in accordance with any instructions supplied with them.
Dog toys, clothing, leads, harnesses and accessories should be checked regularly for signs of damage or excessive wear. Pets should be appropriately supervised when using products where supervision is advisable.
Nothing in this section excludes or limits any liability that cannot legally be excluded.
8. Website use
You may use our website only for lawful purposes.
You must not misuse the website, attempt unauthorised access, introduce malicious software, interfere with its operation or use it in a way that infringes the rights of another person.
9. Intellectual property
Unless otherwise stated, the content of this website, including our branding, text, graphics and original imagery, belongs to us or is used by us with permission.
Third-party product images, trademarks and other materials remain the property of their respective owners.
10. Third-party services
Our store is hosted by Shopify and may use other third-party services to provide payment processing, fulfilment, delivery and other functions.
Your purchase is made from The Spoilt Dog Co., not Shopify.
11. Liability
Nothing in these terms excludes or limits our liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a consumer purchase, to the extent permitted by law.
Your statutory consumer rights are unaffected.
12. Privacy
We process personal information in accordance with our Privacy Policy and applicable data-protection law.
13. Changes to these terms
We may update these Terms of Service from time to time. The terms applying to an order will be those in force when that order is placed.
14. Governing law
These terms are governed by the laws of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you will also retain any mandatory rights and protections provided by the law applicable to you.
